Summary:
This talk aims to address the human rights impacts of European businesses in overseas operations, by providing a comparative Canadian perspective. The presentation begins with a discussion of the “governance gap” paradigm where both transnational corporations and their regulators are increasingly under pressure to address human rights impacts beyond the internal market. In 2011, the United Nations Human Rights Council endorsed the Guiding Principles on Business and Human Rights, representing a significant policy milestone now shaping virtually all efforts moving forward.
Ensuring the UNGP’s Access to Remedy remains elusive in the EU, and this talk summarizes the development of the European Commission’s Strategy on Corporate Social Responsibility, and compares the status quo with the mandate of the Canadian Office of the Extractive Sector Corporate Social Responsibility Counsellor. The discussion concludes with the introduction of a private arbitration-based proposal as an avenue for future innovation, and its potential fit within the current EU framework.
About the Speaker:
Eric Cheng currently lectures on CSR and Corporate Governance at Southwest University of Political Science & Law in Chongqing, China. Eric holds a law degree from Exeter University, a psychology degree from the University of Toronto, and pursued advanced studies in international law at Oxford University, National University of Ireland Galway and at the Hague Academy of International Law after serving as a Clerk at the Ontario Court of Justice and pursuing his legal training at a United Nations litigation office.
